giga's Store Terms
These are the terms relating to the giga! Store and they shall apply to all orders for devices and accessories placed through giga!’s Store (these “Terms” or “giga!’s Store Terms”). These Terms supplement giga!’s “Mobile Terms and Conditions” (https://www.giga.com.sg/TnC) and giga’s “App and Website Terms & Conditions and Privacy Policy” (https://www.giga.com.sg/PrivacyPolicy), all of which may be updated by us from time to time. The most recent version of these Terms will apply and will be available on our online store. In the event of any inconsistency between these giga! Store Terms, the Mobile Terms and Conditions and the App and Website Terms & Conditions, these giga! Store Terms shall prevail for such orders on our store.
1. Applicability
1.1. These giga Store Terms shall apply to all orders and accessories placed through giga!’s store.
2. Placing Orders / Stock Availability
2.1. Your order on our store is an offer to purchase. All orders are subject to our acceptance, stock availability, payment authorisation and fraud / security checks. We may reject or cancel any order before dispatch if stock is unavailable, the listing contains an error, payment fails, or we reasonably suspect fraud or unauthorised activity. If payment has been effected for a cancelled order, we will process the refund of the relevant amount to the original payment method.
3. Prices and payment
3.1. Unless otherwise stated by us, all prices listed are in Singapore dollars and inclusive of 9% GST, which will be adjusted based on prevailing GST rates. Payments are processed by our authorised third-party payment service providers. We may require payment verification before fulfilling an order.
3.2. We may revise our prices at any time in our sole discretion.
4. Delivery
4.1. Delivery is available only to addresses in Singapore approved by us. Delivery dates are estimates only. Delivery is completed when the device is delivered to the selected address and acknowledged by the recipient, or otherwise recorded as successfully delivered under our delivery process. Title of the goods shall pass upon full payment and successful delivery, risk shall also pass upon successful delivery.
4.2. If delivery cannot be completed due to an incorrect address, unavailability of the recipient, refusal to accept delivery, or other circumstances attributable to you, we may reattempt delivery, charge an applicable redelivery fee, or cancel and restock the order after repeated failed attempts.
4.3. Courier assisted unboxing or on-site inspection of the devices are not part of the delivery service. You should inspect the device promptly after receipt and notify us before signing off if the wrong item was supplied, items are missing, or if there is visible transit damage, without prejudice to your statutory rights.
5. Returns / Defective Goods
5.1. Unless otherwise stated, we do not accept returns or exchanges for change of mind after successful delivery. Nothing in these giga! Store Terms excludes or limits any rights that cannot lawfully be excluded.
5.2. Where a device is defective or damaged, we may provide the applicable remedy required or permitted by law.
6. Product Warranty
6.1. giga! does not provide any product warranty for devices sold through the giga! Store. Any warranty in respect of a device is provided solely by the manufacturer and is subject to the manufacturer’s applicable warranty and service terms.
6.2. Except as expressly stated in these Terms, and to the fullest extent permitted by law, giga! does not provide any separate warranty in respect of devices sold through the Store. Any manufacturer warranty will apply in accordance with the relevant manufacturer’s terms. Nothing in these Terms excludes or limits any rights or remedies that cannot lawfully be excluded or limited.
7. Other legal matters
7.1. Intellectual Property
7.1.1. Any and all of our Intellectual Property will continue to belong to us or our licensor(s). You may not use or permit anyone to use any of our Intellectual Property.
7.2. Variations
7.2.1. We may from time to time change any of these giga Store terms & conditions and/or any other applicable terms and conditions for the devices you purchase from giga’s storefront (including any revision to pricing). The display of the revised terms & conditions on our website will constitute notice of the changes.
7.3. Matters outside of our control
7.3.1. We will not be liable for any delay or failure in performance resulting from matters beyond our control.
7.4. No waiver
7.4.1. If we do not, or if we delay, the exercise or enforcement of any of our rights under these Terms, we will not be considered to have waived our rights.
7.4.2. If any part of these Terms is invalid, illegal or unenforceable, the remaining provisions shall not be affected.
7.5. Rights of third parties
7.5.1. Save for our affiliates, third parties who are not involved cannot enforce these Terms under the Contracts (Rights of Third Parties) Act 2001 of Singapore.
7.6. Applicable laws
7.6.1. These Terms are governed by Singapore law.
7.6.2. Both parties submit to the jurisdiction of the Singapore courts.
